Abstract
Capital markets are part of the economy. The effective functioning and reliability of the
markets are in close relationship with the interests of investors and the country's
economy. In this sense, the increase of activities in the capital markets also started the
increase of the manipulations of the stock market. In this study, the crime of information
abuse, which is enacted in Article 106 of the Capital Market Code no. 6362 that regulates
the mentioned manipulations as a crime, will be examined.
Sermaye piyasaları, ekonominin bir parçasıdır. Piyasaların etkin şekilde çalışması ve
güvenilirliği yatırımcılar ve ülke ekonomisinin menfaatleriyle yakın ilişki içerisindedir. Bu
anlamda sermaye piyasalarındaki faaliyetlerin artması, beraberinde borsa
manipülasyonlarını da arttırmaya başlamıştır. Bu çalışmada da söz konusu
manipülasyonların suç olarak düzenlendiği 6362 sayılı Sermaye Piyasası Kanunu'nun 106.
maddesinde düzenlenen bilgi suistimali suçu incelenecektir.
