Abstract

Classical legal studies approach the judicial institution as an authority that must impose its control over individuals and society to achieve justice. However, modern studies on judicial security center around a different core idea: the necessity for individuals and communities within a state to have confidence in the judicial institution and to feel reassured about the fairness and integrity of its judgments, decisions, and judicial directives. This trust serves as one of the fundamental pillars ensuring societal stability and the continued advancement of political, economic, and social structures.

Within this framework, this research presents an applied study on the concept of judicial security in the city of Madinah during the Prophetic era. It seeks to explore the general principles of judicial security as reflected in the Sunnah of the Prophet ﷺ, particularly through his life and governance. The study focuses on the Book of judgments (Kitāb al-Aḥkām) in Sahih al-Bukhari as its primary field of application.

To maintain the research scope, this study will not delve into the details of judicial legislation across different Islamic jurisprudential schools, nor will it extensively discuss the constitutional value of judicial security or the technical procedures for its implementation in modern state institutions.
